Pendleton sentenced

Prison time for felonies, misdemeanors since 2011
James William Pendleton was sentenced on June 23 for crimes going as far back as 2011. Seventh Judicial District Judge Lyle Anderson traveled from Moab to Price for the sentencing. Pendleton had a total of seven felony charges and five misdemeanors.
Pendleton’s sentences included:
• Up to five years in a state correctional facility for a third degree felony attempted kidnapping charge, up to five years for a third degree felony attempted manslaughter charge. These charges pertain to the smoke inhalation death of Brian W. Swink, who was found dead in the basement of a burning house on July 29, 2014;
Additional counts
• Up to one year for a class A misdemeanor attempted tampering with a witness;
• Up to five years for a third degree felony assault by a prisoner charge;
• Up to five years for the third degree felony possession of a controlled substance charge;
• Up to one year for the class A misdemeanor assault charge;
• Up to one year for a class A misdemeanor false statements at a preliminary hearing;
• Up to five years for a third degree felony burglary charge;
• Up to five years for a third degree felony theft charge;
• Up to five years for a felony criminal mischief charge;
• Up to one year for a class A misdemeanor attempted possession without permission of prohibited items in a correctional facility;
• And up to one year for a class A misdemeanor theft charge with time served on the three additional class C charges of operating a vehicle without insurance, failure to register or expired vehicle and no valid license/expired license charge.
Pendleton was also sentenced to up to five years in a state correctional facility for a third degree felony theft charge from Emery Country, with a restitution hearing set for July 20 at 1 pm.
All the charges from Carbon County will run concurrent, while the Emery County felony theft charge will run consecutive to the Carbon sentences.
