A Price man has been sentenced to prison on seven felony counts of Sexual Exploitation of a Minor and one felony count of Entice, Solicit, Seduce or Lure a Minor by Internet or Text.
Twenty-nine-year-old Derek Joe Gutierrez was sentenced by Judge George Harmond Monday in 7th District Court to an indeterminate term of not less than one year nor more than fifteen years in the Utah State Prison on each of the sexual exploitation charges, which date back to March of 2016.
Based on the conviction of soliciting a minor, Gutierrez was sentenced to an indeterminate term not to exceed five years in prison. Gutierrez entered guilty pleas on eight charges in November. An additional 23 charges were dismissed with prejudice.
The prison sentences are to run concurrently one with another. No fine was imposed but the defendant was ordered to pay any restitution if the minor pursues counseling or therapy.
Gutierrez was remanded to the custody of the Carbon County Sheriff’s Office for transportation to the Utah State Prison.
